Terms & Conditions

1.Agreement

1.1. These Terms and Conditions ‘T&Cs’ are intended to be informative and facilitate a smooth rental experience.  Please do not hesitate to get in touch with any related questions.

1.2. In these T&Cs SDF Chalet Grand-Duc, of 153 Chemin de Nantaux, 74110, Montriond, France, may hereafter be referred to as ‘we’, ‘our’, or ‘us’.  The ‘client’ means all persons named on the ‘booking form’, including anyone who is added or substituted at a later date and may hereafter be referred to as ‘you’ or ‘your’.

1.3. The T&Cs contained in this document together with your booking form comprise the contract between us and all persons listed on the client.

1.4. You must read all these terms and conditions carefully before booking with us.

1.5. The person who completes the booking form on behalf of the client (the ‘party leader’) acts on behalf of all the persons within that client party in accepting these T&Cs.

1.6. When booking with SDF Chalet Grand-Duc, the party leader warrants that:

1.6.1. he/she is over 18 years old;

1.6.2. he/she has read the ‘T&Cs’ and agrees that all members of the group are bound by them without restriction or reservation

1.6.3. he/she will bring the T&Cs to the attention of all party members, including anyone who is added or substituted at a later date

1.6.4. he/she has the authority to accept, on behalf of all party members, the T&Cs;

1.6.5. he/she is responsible, on behalf of all members of the party, for all matters relating to the booking, thus he/she will be personally liable for all monies due to SDF Chalet Grand-Duc, irrespective of party size and final guests

1.6.6. all information provided to us is accurate

1.7. The party leader is deemed to have made the booking exclusively on his/her own behalf and on behalf of the other party members staying with him/her – bookings on behalf of third parties are not permitted.

1.8. Under no circumstances are additional guests allowed to stay in the property other than those specified on the booking form.  Failure to comply with this may result in your booking being terminated immediately in resort and you and your party being asked to vacate the property immediately.  No compensation will be paid in such an event.

 

2.Booking Confirmation and Payment

2.1. No booking will be final and no contract will exist between us and the client until we have received both a completed booking form and accompanying deposit payment (detailed in section 2.2), or full payment as applicable, the party leader has completed our verification process, and we have confirmed the booking in writing.

2.2. A non-refundable deposit of 25% of the total cost is required at the time of booking.  A booking will not be confirmed until the deposit has been received.  The deposit is non-refundable in all and any circumstances (apart from cancellation by us under 4.6) as it covers the unavoidable administrative costs and fixed overheads of SDF Chalet Grand-Duc.

2.3. The balance payment for the booking is payable no later than ten weeks prior to your arrival date (‘balance payment date’).

2.4. If you are booking with us within ten weeks of your arrival date, payment in full will be required at the time of booking.

2.5. When you receive your booking confirmation email, please check all the details carefully, to ensure that they are correct; the booking confirmation email, booking form and these terms and conditions form the contract between us. If there are any discrepancies in the booking confirmation email, please bring these to our attention within seven business days, otherwise we will assume that the details shown are correct and amendment charges may be incurred where changes are subsequently required.

2.6. The party leader will be liable for full payment for all persons in the client party and for any other persons added or substituted at a later date. If payment has not been received by SDF Chalet Grand-Duc by the balance payment date, we reserve the right to cancel the booking, retain the deposit paid and re-sell the booking without further notice.

2.7. The party leader must arrange for all and any payments, including deposit and balance payments, to be made in a lump sum.  SDF Chalet Grand-Duc cannot accept multiple payments from multiple individuals.

2.8. Should any additional payments become due during your stay these amounts must be paid prior to your departure.

2.9. Payments made by the client will only be considered final once SDF Chalet Grand-Duc has received the said sums.

2.10. SDF Chalet Grand-Duc will not be held responsible for charges incurred by yourself for international bank transfer costs or charges imposed on you by your bank or card issuer.  This also includes payment discrepancies or additional costs caused by variations in exchange rates used by your bank or card issuer.

2.11. By agreeing to these terms and conditions you agree to not attempt to recover the non-refundable part of the contract via your credit card provider, except in the case where SDF Chalet Grand-Duc ceases trading due to insolvency and consequently is unable to fulfil the booking.

2.12. If you, or your party, change any of your flight details after having made your booking, and SDF Chalet Grand-Duc has made airport transfer, or any other, arrangements on your behalf, an administrative charge of €50 may be incurred which will be added to your final balance.

2.13. Prices are based on exclusive use of the property and will therefore remain the same irrespective of the number of guests, up to the maximum stated capacity.

2.14. Stadard prices quoted on the SDF Chalet Grand-Duc website are for 7 nights self-catered accommodation. Prices include a welcome pack, linen, towels, toiletries and cleaning of the property before, during and after your stay.  Prices do not include lift passes, equipment hire, lessons, flights, transfers or travel costs, travel, holiday and medical insurance, childcare or any other costs.

2.15. SDF Chalet Grand-Duc guarantees the price of your rental as quoted at the time of booking and as stated on your booking confirmation email.

2.16. SDF Chalet Grand-Duc reserves the right to increase or decrease the advertised price of unsold rental periods at any time.

2.17. We reserve the right to increase our prices and therefore offer no guarantee that postponed reservations will be offered at the same price as the original booking.

2.18. Prices include taxe de séjour tourist tax and VAT, as applicable.

 

3.Amendments

3.1. You may request alterations to your booking at any time prior to your arrival, subject to any difference in cost being paid prior to confirmation.  Please submit all requests to SDF Chalet Grand-Duc in writing and we will do our utmost to accommodate your requests.  However, such requests shall not be taken to form part of the contract between you and SDF Chalet Grand-Duc until acceptance of the alteration has been confirmed in writing by SDF Chalet Grand-Duc and any difference in price has been paid by you.

3.2. It should be noted that all requests are subject to availability and may also be subject to a fee, which will be confirmed in writing.

3.3. A request to change dates to a future season or made within ten weeks of arrival, will be deemed a full cancellation and the cancellation charges outlined in clause 4 will apply.

 

4.Cancellation

4.1. The party leader must confirm any cancellation by the client in writing.  The date on which written notification is received by us will determine the level of cancellation charges applicable.  The cancellation charges are expressed as a percentage of the total booking cost.  SDF Chalet Grand-Duc accepts no responsibility for non-delivery or non-receipt of such written cancellation.

4.2. Please note many travel insurance policies cover the eventuality of having to cancel a holiday in certain circumstances so please check your own travel insurance policy when booking for details and check with your insurance provider that their terms are sufficient to cover your booking.

4.3. If the accommodation you have booked is available to be occupied, but you are unable to travel, then according to French law, SDF Chalet Grand-Duc is not legally obliged to reimburse you differently to the terms laid out in clause 4.

4.4. The cancellation charges are as follows:

       Days prior to arrival                    Cancellation charge (% total booking cost)

       More than 70 days:                   25% (i.e. loss of non-refundable deposit)

       Between 69 – 49 days:              50%

       Between 48 – 29 days:              75%

       Less than 29 days:                     100%

4.5. Refunds (following deduction of the cancellation charges) will only be made to the client where the full balance has been paid.

4.6. In the unlikely event that SDF Chalet Grand-Duc is obliged to cancel your booking for any reason (other than in the circumstances outlined in clause 14) we will immediately issue a full refund of ALL payments made by the client to SDF Chalet Grand Duc.

4.7. For the avoidance of doubt, SDF Chalet Grand-Duc will not be liable to pay you any compensation or refund if it fails to perform any of its obligations under your booking resulting from events, circumstances or causes beyond its reasonable control (and which could not, even with all due care, be foreseen or avoided).  Such events may include, but are not limited to, acts of God, war or threat of war, riots, civil commotion, terrorist activities (actual or potential), labour disputes, volcanic ash clouds, governmental decisions, natural or nuclear disasters, epidemics, pandemics, adverse weather conditions, fires, closure of ports and airports, and any other similar events beyond our control (“Force Majeure”).

 

5.Client Responsibilities & Behaviour

5.1. Chalet Grand-Duc is exclusively non-smoking, both for guest comfort and in line with the French law.  Those wishing to smoke should do so outside the property, disposing of cigarette butts in a designated ashtray.  Any group found to have anyone smoking in the properties will be charged €500 for an external commercial cleaning company fee.

5.2. It is your responsibility to properly secure the exits and windows of the property, including balconies, terraces, garage stores and hot-tub cover and you will be liable for any costs incurred by SDF Chalet Grand-Duc as a result of your negligence.

5.3. SDF Chalet Grand-Duc will not be held responsible for any theft or loss of any personal possessions from our premises.  SDF Chalet Grand-Duc will take all reasonable steps to ensure the security of guests’ personal possessions.  However, the primary responsibility lies with the client.

5.4. It is the responsibility of the party leader to ensure that each member of the party is responsible for the safety of all their own personal possessions, documents and equipment.

5.5. Guests should act in a way that is respectful to staff, other guests and local residents at all times and in a way that does not damage SDF Chalet Grand-Duc’s reputation.  All guests must recognise that the property is located within a calm residential area and thus keep noise levels appropriate at all times and minimise any disruption to neighbours.  Guests must observe a 22:00 curfew for outdoor noise or excessive noise within the property.

5.6. SDF Chalet Grand-Duc will not be held responsible for any official fees or fines incurred for noise or breach of peace and reserves the right to refuse to further accommodate guests in breach of this section.  Groups in breach of any part(s) of this section will result in all contractual obligations being terminated immediately and no compensation will be payable.

5.7. The use of illegal substances will not be tolerated.  Anyone found to be using or supplying such substances will be evicted from the property with immediate effect.  This could lead to the entire group being evicted.  No compensation will be paid.

5.8. It is your responsibility to ensure you have all the necessary legal travel documents in place depending on your nationality.  It is your responsibility to check which documents are required before you travel and ensure you have those in place for the duration of your holiday.  Please ensure that your passport is valid well beyond your return date.  SDF Chalet Grand-Duc will not be held responsible for any legal changes made to travel requirements between the time of booking your holiday to departure.

5.9. No refunds or compensation will be made by SDF Chalet Grand-Duc in the circumstance where any government changes to travel regulations are imposed.

5.10. You are responsible for ensuring that you have full medical and travel insurance cover throughout your stay at SDF Chalet Grand-Duc from the date the booking is made.

5.11. Winter/mountain sports and travel involve a degree of risk and therefore we insist that you take out adequate travel insurance in order to cover any accidents during your holiday, for which SDF Chalet Grand-Duc will not be held responsible.

5.12. SDF Chalet Grand-Duc will only be liable for death or personal injury if it is a direct result of an act or omission of ours in the performance of our duties, unless where the cause of death or personal injury is due to: your acts or omissions or those of a third party not connected with the provision of your booking; an event which could not have been foreseen or prevented even by exercising all due care.  However, acceptance of this liability is subject to you informing us of any claim in writing within 7 days of the end of your holiday.

5.13. It is your responsibility to park your car in a safe and designated spot that does not obstruct any neighbouring properties or snow plough access.  Any personal or rented vehicles are left at the owners risk and should be parked in a safe and legal parking space.  SDF Chalet Grand-Duc will not be held responsible for damage to or theft from any vehicle.

5.14. It is your responsibility to familiarise yourself with the fire exits and fire extinguishers in the property when you arrive.

 

6.Damages, Loss, Surplus Cleaning, Theft & Breakages

6.1. SDF Chalet Grand-Duc will endeavour to resolve any discrepancies during your stay.  It is also your responsibility to report to us any damage you notice to the property on arrival or during your stay.  You remain responsible for any damage to the property or its facilities caused by you or any member of your party during your stay.

6.2. By accepting these terms and conditions, the client undertakes to take good care of the items, goods and equipment forming part of the property or made available to him/her during his stay and to return them at the end of his/her stay in the same condition as they found them on arrival.

6.3. SDF Chalet Grand-Duc will require a security guarantee to cover any loss or damage caused to property and / or additional in-resort costs.  We use the services of SUPERHOG for guest verification and damage protection: www.superhog.com

6.4. You will be liable for any loss, breakages or damage to the property or adjacent properties during your stay caused by any member of the client party, your employees or your visitors to the property. These costs will be deducted from the security deposit. If the damage is greater than the amount of the security deposit, you must immediately pay the costs to SDF Chalet Grand-Duc, the amount of which will be advised to you.

6.5. Refunding your security deposit may be delayed if the costs of any repair have to be determined.

6.6. Should any items of property be lost or damaged during your stay, you must notify SDF Chalet Grand-Duc.  Any damage or loss caused by any member of the group must be paid for in full before departure by the party leader, on the basis of the cost of replacing them with new material.

6.7. In the event that any damage to the property is not brought to our attention during this period, and is discovered after your departure, we will contact you within 72 hours of your departure from the property to advise you of the cost of repairing the damage to the property.

6.8. SDF Chalet Grand-Duc shall be entitled to recover from the party leader the cost of any damage caused by you or a member of your party.

6.9. Our keys are security keys, therefore, should you lose a key, you will be charged €250 for a replacement.

6.10. Any client not properly securing the exits or windows of the property, including balcony, garage and hot-tub access doors, will be liable for any SDF Chalet Grand-Duc property stolen as a result of that negligence.

6.11. SDF Chalet Grand-Duc will not be held responsible for any theft or loss of any personal possessions from our premises.  Whilst SDF Chalet Grand-Duc will endeavour to ensure the security of guests’ personal possessions, SDF Chalet Grand-Duc cannot guarantee it.

6.12. It is up to the party leader to ensure that each member of the party is responsible for the safety of all their own personal possessions, documents and equipment.  No responsibility or liability will be accepted in respect of such items, as it is a condition of your booking (and therefore reasonably assumed by SDF Chalet Grand-Duc) that all guests have taken out appropriate insurance to cover such loss and/or damage.  For the avoidance of doubt, please note that this section also applies to mountain bikes, road bikes, ski/snowboard equipment and any other “high value items” that guests have brought with them.

 

7.Check-in, Check-out & Departure Checklist

7.1. Check-in time is strictly 16:00. Check-out time is strictly 10:00.  Whilst we understand that some groups may wish to arrive earlier or depart later on those days, we need to maintain these timings in order to prepare the properties for the next guests.  When possible, we will store luggage for you should your flight schedule mean you arrive before or after our check-in and checkout times, however, we cannot guarantee this.  There will be no access to the property before check-in or after check-out times, unless expressly agreed otherwise in writing.

7.2. Groups must ensure that they adhere to the following conditions before check-out.  Failure to complete the following checklist may result in a €500 surplus cleaning fee:

  • Dispose of all food and beverage from fridge, freezer, cupboards and cooking appliances

  • Empty dishwasher, clean all cooking appliances (including BBQ if used) and return dishes to cupboards

  • Dispose of rubbish and recycling from all bins at local collection point

  • Report any damages or breakages to us

  • Ensure all items are as you found them on arrival.

 

8.Property Facilities

8.1. In order to maintain and protect our property, outdoor shoes, ski boots and snowboard boots are not permitted anywhere inside the property other than the entrance boot room.  Slippers are provided for your convenience.

8.2. All outdoor equipment such as skis, ski poles, snowboards, snow shoes, sledges and bikes etc. must be left in the designated garage store, which is both secure and under video surveillance.  This includes any equipment belonging to the group.  On arrival you will be shown the storage areas where your equipment can be kept.  All maintenance and fitting of equipment must be done in the boot room or an outdoor area.

8.3. Wet clothes must not be left on / to drip on, wooden floors, or any other wooden surfaces, and any spillages should be cleaned-up immediately to prevent staining of the wood.

8.4. Both indoor and outdoor fires must be managed sensibly and should not be overloaded nor obstructed in any way.  The indoor fire must be operated with the door fully closed at all times. The outdoor fire must not be used in the event of windy or very dry conditions.  Clothes should not be dried by the fire. SDF Chalet Grand-Duc will not be held responsible for any damage to items as a result of being placed too close to the fire.

8.5. Client use of the hot-tub is at your own risk and SDF Chalet Grand-Duc accepts no responsibility for accidents or injuries sustained while using this, or any other, facility.

8.6. We recommend that children under the age of 12 and pregnant women do not use the hot-tub.  Under 16 year olds must be accompanied at all times in the hot-tub.  The hot-tub cover must be correctly secured using the four security straps when not in use.  Please be aware that the area around the hot-tub can become slippery and that ice may form on the deck around it in the winter season.  The maximum number of guests allowed in the hot-tub at any one time (seven) must be respected.  We advise guests to remove jewellery before using the hot-tub; broken or lost items can ruin pumps, hot metal can burn skin and the client will be liable for associated repair and / or recovery costs.  When using the hot-tub, drinks must be kept in plastic glasses without exception.  Any broken glass in a hot tub will result in the hot tub being permanently closed and any subsequent damage, repair costs or inconvenience to the following weeks clients will be charged accordingly and before the group’s departure.  We reserve the right to close the hot tub at any time if it is being misused, if guests are not observing rules or curfews, or if there is any chemical imbalance or breakdown.  Compensation will not be payable in such cases and prior notice is not necessary.  SDF Chalet Grand-Duc takes meticulous care of its hot tub and drain, clean and replace water for every new group, including a chemical check.  In the interest of hygiene, all persons using the hot tub are required to shower before entering.

8.7. Please note that hot tubs are normally out of use for at least one day per week while they are cleaned. Should any leisure facility become unavailable for any reason during your stay, we cannot guarantee being able to repair or replace it during your stay and we do not offer compensation for inconvenience or curtailed use in such an event.

 

9.Third-party Suppliers

9.1. SDF Chalet Grand-Duc may assist with arranging extra services for your stay.  These services are subject to the terms and conditions of the individual third party companies.  SDF Chalet Grand-Duc reserves the right to charge an administration fee on such bookings.

9.2. In the event of any unforeseen circumstances, accident or event due to the actions of a third party, SDF Chalet Grand-Duc shall not be held liable.  Bookings made to third party providers by us on behalf of the client will be bound by the third party supplier’s terms and conditions, which are available upon request.

9.3. The party leader agrees to guarantee payment for any additional services requested by any member of the party, at any time.

 

10.Travel

10.1. Please inform us of the transport arrangements for your party at least four weeks prior to departure.

10.2. SDF Chalet Grand-Duc cannot accept responsibility for guests missing transport connections for any reason and no credit or refund will be given if you are unable to take up part, or all, of your stay as a result.

 

11.Children

11.1. We are able to provide a certain number of cots and highchairs and these must be booked in advance.  Please check these requests have been recorded on your booking form.  SDF Chalet Grand-Duc accepts no responsibility should an accident or injury occur as a result of the use of such items.  Parents assume full responsibility for the safety and wellbeing of their children at all times.

11.2. No matter how much care is taken, our property is not childproof.  SDF Chalet Grand-Duc will not be held responsible for any accidents occurring on the property.  It is the parents’ responsibility to ensure their children (16 or under as per French law) are supervised at all times.

 

12.Pets

12.1. No pets are allowed on the property under any circumstances.  Anyone found with pets on the property will be evicted from the property with immediate effect.  This could lead to the entire group being evicted.  No compensation will be paid.

 

13.Insurance

13.1. Please note that SDF Chalet Grand-Duc does not provide winter sports or other travel insurance to its clients. It is your responsibility to ensure that you and your party have appropriate and adequate insurance.

13.2. It is a condition of booking with SDF Chalet Grand-Duc that all clients (including all members of their party) are able to provide proof of personal insurance covering:

  • cancellation or interruption of your trip;

  • travel delays and transfer costs (including additional costs incurred in the event of delay);

  • emergency medical expenses, including, but not limited to, mountain rescue, ambulance and repatriation costs;

  • winter sports and any activities you may do in the resort;

  • risks and costs incurred by third parties as a result of damage to property or adjacent

  • property caused by you or any member of your party, your employees or visitors during your stay;

13.3. In the event that you fail to obtain appropriate insurance in accordance with this clause, we will not be liable for any costs incurred or claims made against us as a result of your failure to comply with this condition.

13.4. We also recommend that you take out adequate insurance to cover your personal belongings.

13.5. In order for us to assist you in an emergency, it is helpful for us to have information about your travel insurance policy. Please provide us with this information at the time of booking.

 

14.Limitation of Liability

14.1. SDF Chalet Grand-Duc does not accept any liability where-so-ever or how-so-ever arising, or pay compensation for:

14.1.1. Any Force Majeure event.

14.1.2. Adverse weather or traffic conditions, avalanche, mud slips, slides and snow conditions and the effect any of these may have on travel arrangements, accommodation and activities.

14.1.3. Limitations imposed by resort authorities, ski lifts, ski school or ski hire operators.

14.1.4. Travel arrangements made by the group or on behalf of the group.

14.1.5. Any personal injury or death, where-so-ever or how-so-ever arising, caused to any visitor and/or any member of the group for their duration of stay.

14.2. If you become ill during your stay and cannot travel to your next destination, SDF Chalet Grand-Duc cannot accept liability or responsibility to provide you with accommodation beyond your contracted booking dates.

14.3. These limitations are not intended to exclude any statutory rights the group and/or visitor may have.

 

15.Resolving Problems

15.1. In the unlikely event that you are unhappy with any aspect of your rental, you must notify us of your complaint immediately.  All complaints will be dealt with seriously and we will endeavour to rectify the situation as soon as possible.

15.2. If, for any reason, the problem cannot be resolved locally whilst you are in resort and you remain dissatisfied, you must inform us in writing of your complaint within 28 days of the end of your stay, so that the complaint may be investigated fully and in a timely fashion.

15.3. Any complaints made on or after departure will not be considered.  Complaints cannot be accepted for snow conditions, weather, closures of ski-lifts, services offered by third party suppliers, or anything outside of SDF Chalet Grand-Duc’ direct control.

15.4. Our liability is in all cases limited to the reimbursement of monies paid by the client and we shall not be considered as responsible or in default for any delay or non-performance resulting from the occurrence of a case of force majeure usually recognised by French jurisprudence.

 

16.Data Protection

16.1. We are committed to protecting your privacy. For further information, please see our Privacy Policy which explains how we manage the information we collect, use and disclose. It also explains how to contact us if you have any queries about our management of, or would like to request access to, your personal information.

 

17.Terms of Contract

17.1. All descriptions on the SDF Chalet Grand-Duc website are given in good faith and are believed to be correct.  This is in relation to all aspects, including activity pricing and information.

17.2. For the avoidance of doubt in the event of any conflict between the details on the SDF Chalet Grand-Duc website and the terms and conditions, the provisions of the terms and conditions prevail.

17.3. If you book through a Travel Agent, they will act to pass information from you to us and vice versa. They may also receive payment from you for your reservation and will subsequently transfer the funds to SDF Chalet Grand-Duc. Any advice given to you from your Travel Agent, which is not based on advice given to them by us, is their responsibility.  In these circumstances, we do not accept liability if incorrect advice is given to you by your Travel Agent.

17.4. We partner with third parties and so our chalet may appear on third party websites.  We have no control over the contents and practices of these websites.  You access and rely upon the contents of these third party websites solely at your own risk.  We accept no responsibility for the contents of and practices of any third party websites. You should therefore not solely rely on any descriptions which are not on our website.

17.5. SDF Chalet Grand-Duc is not a package travel tour operator and the Package Travel Regulations and Linked Arrangements Regulations do not apply to the services provided by SDF Chalet Grand-Duc.

 

18.Miscellaneous

18.1. In the absence of proof to the contrary, the data recorded in the SDF Chalet Grand-Duc computer system constitutes proof of all transactions concluded with the client.

 

19.Brochure & Website Accuracy

19.1. All reasonable care has been taken to ensure that the descriptions, facts or opinions on our website or in our promotional material are correct to the best of our knowledge.

19.2. Opinions expressed are personal to the authors and photographs only relate to a specific destination when specifically captioned.  You should bear in mind that in relation to the information given about the resorts and certain facilities available within resort, we cannot guarantee accuracy at all times or that any particular activity will take place, as these services are not under our control.

19.3. Facilities such as lifts, shuttle bus services, ice rinks and swimming pools may not be operational at the beginning or the end of the season.  This may be due to factors such as weather or the number of tourists in resort.  These decisions are often made on a day-by-day basis by their operators and we are not always informed.  Where we are informed, we will do our utmost to let you know.

19.4. All information we supply regarding third party suppliers has been supplied to us by them in good faith and we cannot guarantee that such information is complete or up to date.

 

20.Governing Law, Jurisdiction & Severance

20.1. These booking conditions and any matters arising from them are subject to and governed by French Law and are subject to the jurisdiction of the French Courts

20.2. All correspondence must be sent to info@chaletgrandduc.com

20.3. If any provision of these terms and conditions is held to be invalid or unenforceable by any judicial or other competent authority, all other provisions of this agreement will remain in full force and effect and will not in any way be impaired.
